SHIPMENTS AND DELIVERIES
The services and products offered through the Website are intended for donation by Users in exchange for gift items and other products offered by Fundación Soñar Despierto.
From the Website, Fundación Soñar Despierto will ship orders to any part of Spain, except Tenerife, Ceuta and Melilla. Unless otherwise specified, the products purchased will be, by default, shipped to the physical address that the User indicates to the Fundación Soñar Despierto in the registration form, except in case of force majeure. As a general rule, and provided that the User has made full payment and this has been received by the Foundation Soñar Despierto, the Products purchased will be shipped without undue delay and in any case within a maximum period of thirty (30) days from the date on which the order is formalized or being the maximum delivery period of 3 working days from the time of confirming your order, or 21 working days in case of product customization (solidarity celebrations). For special orders, please consult delivery times.
In order to place orders through the Website, the User must provide a series of data prior to the order, through the donation form, which will be necessary to manage the donation order.
Two delivery attempts will be made to the address indicated, and in case of failure, the product will be left at the disposal of the donor at the logistic operator's office closest to the donor's address, where it can be picked up during a period of 7 days.
The Daydreaming Foundation recommends the User to validate any information regarding the Product prior to any use or performance based on such information. All Product information is subject to change without notice. Lender also assumes no responsibility for typographical or other errors or omissions in the Product information.
In any case, in order to donate through the Fundación Soñar Despierto, the User must be over eighteen (18) years of age.
EXCHANGES AND RETURNS
2.1 Returns due to manufacturing defects.
The Fundación Soñar Despierto is responsible for the lack of conformity of the products that becomes apparent within two (2) years from the delivery thereof, and the User may return them in such case.
According to the standard, products are deemed to be compliant when:
- Conform to the description given by the seller and possess the qualities of the product that the seller has presented to the consumer and user in the form of a sample or model;
- Are suitable for the uses to which products of the same type are ordinarily destined;
- Are suitable for any special use required by the consumer and user when he has made it known to the seller at the time of conclusion of the contract, provided that the latter has admitted that the product is suitable for such use.
During the period of two (2) years that Fundación Soñar Despierto must respond for the lack of conformity of the products, only during the first six (6) months it will be presumed that the lack of conformity is attributable to Fundación Soñar Despierto. During the following eighteen (18) months, until the end of the two (2) year period indicated, the User must justify and prove that the lack of conformity is attributable to Fundación Soñar Despierto. In the event that the lack of conformity of the product is not justified and proven to be attributable to Fundación Soñar Despierto, the product may not be returned.
2.2 Refunds for withdrawal.
All Users may exercise their right of withdrawal within a maximum period of fourteen (14) calendar days from the time the product was received, and must be exercised directly against the Fundación Soñar Despierto.
Users may exercise this right of withdrawal when they are not satisfied with the products received in their order and all without penalty and without the need to indicate the reasons for return.
However, the User must bear the direct cost of return to the Fundación Soñar Despierto, whether he/she returns the order completely or decides to return only some of the products in the order. The process may be carried out through the courier service of your choice.
However, in accordance with Article 103 of Royal Legislative Decree 1/2007, of November 16, 2007, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, the right of withdrawal shall not apply in the case of products made according to the specifications of the consumer and user or products that are clearly personalized.
2.3 Product return procedure
To formalize the return, the User must write an email to the address [email protected] to contact the Fundación Soñar Despierto and follow the indicated procedure.
In the event that the User wishes to exchange a product, he/she must exercise his/her right of withdrawal in accordance with the provisions of clause 2.2 and subsequently purchase the new product desired. As stated in this clause, the User shall bear the direct cost of return to the Fundación Soñar Despierto, through the courier service it deems appropriate.
It will be possible to exchange products physically and by appointment at our offices in Madrid, from 9.00 am to 6.00 pm from Monday to Friday. To do so, it will be necessary to write to [email protected] to make an appointment.
